Lasting Power of Attorney

There may come a time, because you are incapable of managing your property and financial affairs or your personal welfare, when you require someone to do this on your behalf. A Lasting Power of Attorney is a legal document that allows you formally to appoint someone you trust to manage your affairs, make decisions and act on your behalf.

From 1st October 2007 the single Enduring Power of Attorney has been replaced by two longer and more complex Lasting Powers of Attorney (LPA), one to deal with Personal and Welfare issues and another to deal with Property and Financial Affairs.

Property and Financial Affairs LPA

A Property and Financial Affairs Lasting Power of Attorney allows you to choose someone you trust to make decisions about how to manage your money and how your property and affairs are conducted.

Personal Welfare LPA

A Personal Welfare Lasting Power of Attorney allows you to choose someone to make decisions about your health care and welfare. This includes decisions to refuse or consent to treatment on your behalf, including life-sustaining treatment and deciding where you live.

An LPA must contain a certificate that the person granting the LPA understands its purpose and the scope of the authority they are giving to the attorney. Only certain designated people can provide this certificate and they must have known the individual creating the LPA for at least two years and cannot be a relative or carer of the donor.
